Terms of Service
§1. Acceptance of Terms
By accessing or using SoCalForeclosures.net (the “Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These Terms constitute a legally binding agreement between you and SoCalForeclosures.net.
§2. What we are — and what we are not
SoCalForeclosures.net is an information and intelligence platform. We are not a licensed real estate broker, attorney, financial advisor, or title company. Nothing on this Service constitutes real estate, legal, tax, or financial advice. Users must independently verify any information before making a purchase, offer, or investment decision.
§3. Eligibility
You must be at least 18 years of age and legally capable of entering into contracts. Registration is invite-only during the Founding Member beta phase. Providing false information during registration is grounds for immediate account termination.
§4. Founding Member Subscription
- Membership fee is $149.99 per month, billed via PayPal, and continues until cancelled.
- Cancellation stops the next billing cycle. Access continues through the end of the current period.
- Credits purchased or earned remain valid so long as your subscription is active or you re-subscribe within 60 days.
- Credits are non-transferable and have no cash value outside the platform.
- Membership seats are capped. Once the cap is reached, new signups are placed on a waitlist.
§5. Lead locking, exclusivity, and credits
- Credits are the sole in-platform currency for locking leads. 1 credit = $1 face value.
- Locking a lead grants you an exclusive time-limited window in which sensitive lead data is hidden from other members.
- Locks can be extended, released, or upgraded per the pricing shown in-app.
- Locks do not convey any ownership, listing rights, or agency in the underlying real estate.
- Refunds are issued in credits only, per the Refund Policy.
§6. SoCalDeals marketplace
When you list a property on SoCalDeals, you represent and warrant that you hold a valid, signed purchase contract with the property owner and are marketing an equitable interest in that contract per California Business & Professions Code §10131.6 and Assembly Bill 1345. You are solely responsible for compliance with all applicable disclosure and wholesaler requirements. SoCalForeclosures.net does not act as a broker, escrow, or party to any transaction.
§7. Off-market rule
The Service enforces an off-market-only policy. Properties currently listed on MLS, Zillow, Redfin, or comparable real estate portals are automatically filtered from the platform. Best-effort filtering — the Service does not guarantee 100% accuracy, and users should independently verify off-market status before taking action on any lead.
§8. No warranty of data accuracy
All lead data is sourced from public records, third-party feeds, and machine analysis. We make no representation or warranty as to the accuracy, completeness, timeliness, or fitness for purpose of any data on the platform. Users must independently verify all information (owner identity, mortgage balance, auction dates, property condition, etc.) before making offers or decisions. Errors happen. Verify.
§9. Prohibited conduct
You may not: (a) resell, redistribute, or make available any platform data to third parties outside your organization; (b) scrape, spider, or crawl the platform outside of officially supported APIs; (c) attempt to reverse-engineer or circumvent access controls; (d) use platform data to harass, harm, or coerce property owners; (e) use the platform for any unlawful purpose. Violation results in account termination and possible legal action.
§10. Intellectual property
The Service, including all software, data models, scoring algorithms, aggregated data, branding, and content, is owned by SoCalForeclosures.net and protected by copyright, trademark, and other laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service for your own real estate activity.
§11. Limitation of liability
To the maximum extent permitted by law, SoCalForeclosures.net and its operators are not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service, including but not limited to lost profits, bad deals, data inaccuracies, or missed opportunities. Total aggregate liability is capped at the amount you paid in the twelve months preceding the claim.
§12. Indemnification
You agree to indemnify and hold harmless SoCalForeclosures.net, its operators, employees, and affiliates from any claims, damages, or expenses arising from your use of the Service, your listings, your offers, or your interactions with property owners.
§13. Governing law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Exclusive venue for any dispute lies in the state or federal courts of Los Angeles County, California.
§14. Changes
We may update these Terms from time to time. Material changes will be announced via email and in-app notification at least 30 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance.
